3	08-05-2013 Heard learned counsel for the petitioner as well as
	learned Additional Public Prosecutor for the State.
	Earlier the prayer for bail of the petitioner was
	rejected by this Court vide order dated 01.03.2012 passed in Cr.
	Misc. No. 1739 of 2012 considering this aspect of the matter that on the basis of confessional statement of petitioner, stolen truck
	was recovered from a garage and some articles were recovered
	from the house of petitioner.

The submission on behalf of the petitioner is that even if the aforesaid facts assumed to be true, then also, at best, petitioner can be prosecuted for the offence punishable under Section 412 of the Indian Penal Code. It is further contended by him that petitioner is in jail custody since 12.04.2010 and having more or less similar allegation, other co-accused have already

been granted privilege of bail by different Benches of this Court.

The learned Judicial Magistrate, 1st Class cum Additional Munsif-II, Patna City has reported vide its letter no. 151 dated 30.04.2013 that the case of petitioner is still pending for commitment.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in connection with Malsalami P.S. Case No. 40 of 2010.
