This application has been filed for modification of order
dated 16.5.2012 passed in Cr. Misc. No. 20623 of 2012 whereby
the order dated 18.8.2011 passed in Cr. Misc. No. 17065 of 2011 has been modified.

Bail was allowed to this petitioner on his undertaking to deposit rupees two lacs and thirty five thousand with instalments after release but within a period of six months.

No instalment is deposited and again further time is sought for depositing instalments.

It is made clear that earlier also he was allowed time but he did not comply.

However, at present non-bailable warrant of arrest is issued against the petitioner due to his non-compliance of undertaking and only time is sought.

In the discussed circumstance, if petitioner surrenders in the trial court within a period of one month from today with demand draft of rupees two lacs and thirty five thousand, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Patna in connection with R.C. No. 28(A) 2006.

The modification application is allowed.

Let this order including the order dated 16.5.2012 passed in Cr. Misc. No. 20623/2012 and the order dated 18.8.2011 passed in Cr. Misc. No. 17065/2011 be communicated to the court below through Fax at the cost of petitioner.
