Learned counsel for the petitioner states that the petitioner has been in custody since 24.04.2013 in connection with alleged offences under Sections 143, 427 and 379 I.P.C. registered in connection with Arwal P.S. Case No. 01 of 2013.

According to First Information Report instituted on the Fardbeyan of Kapileo Singh, Munsi of Brick Kiln, he was sleeping in the Varandah of Office along with Khalasi of J.C.B. and Driver of a Tractor, when one person came and took away his Mobile, Torch, four Blankets and Bedsheets as also the Mobile Phone of the Khalashi and Driver. Thereafter, the Blankets were set on fire which in turn caused fire in the J.C.B. and Tractor as well. The informant stated to have seen four miscreants, though he was informed by another staff member that they were 20-25 persons in all.

It is submitted that the petitioner has not been named in the First Information Report and in any event admittedly, the allegation of taking away the Mobile, Torch etc. are only against one person without identifying the petitioner. The name of the petitioner has surfaced only on the extra judicial confessional statement of co-accused Ramdeo Sah @ Mastan having no evidentiary value.

Considering the aforesaid facts, let the petitioner abovenamed be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Arwal P.S. Case No. 01 of 2013.
