JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 26-09-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which cognizance has been taken under Sections 420, 467 and 468/34 of the Indian Penal Code.
It is alleged that Dharam Deo Pandit transferred a land on 08.10.2007 in favour of the complainant when subsequently cancellation deed was executed on 12.11.2007 when the same land was transferred to petitioner no.2. Petitioner no.1 is the husband of petitioner no.2.
It is submitted by learned counsel for the petitioners that when the consideration amount was not given then the cancellation deed was executed when after three years of the execution of cancellation deed the sale deed was executed in favour of petitioner no.2 and for the same cause of action, Title Suit No. 184 of 2010 was filed on behalf of complainant’s side. It is further submitted that the petitioners are bona fide purchaser.

Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Complaint Case No. 1433 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
