JUSTICE DINESH KUMAR SINGH ORAL ORDER 6 03-09-2013 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torture for non-fulfilment of the dowry demand.

It appears from the order dated 20.08.2013 of this Court that the court took step to reconcile the issue but the parties could not reconcile the same.

It is submitted by learned counsel for the petitioner that the petitioner is still ready to keep the informant as wife with full dignity and honour though, the petitioner is suffering from cancer.

The counsel for the informant submits that the informant is not in a position to accept the offer of the petitioner since she is apprehensive due to past conduct of the petitioner.

It is not in dispute that the petitioner is a doctor and the informant is working as a teacher.

Considering the present stand of the petitioner and the fact that the petitioner is suffering from cancer, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Patna City in connection with Bahadurpur P.S. Case No. 81 of 2012, subject to the conditions as laid down under Section 438(2) Cr.P.C.
