This is an application for bail in a case of misuse. Initially the case was instituted under section 302/34 of the Indian Penal Code. Petitioner was granted bail. The petitioner was declared absconder on 18.11.2005 but he is in custody since 23.06.2009. Trial of the other accused persons has already concluded and against the judgment of trial court appeal is pending before this Court.

It is submitted by the learned counsel for the petitioner that petitioner will attend the court on each and each and every dates and he will not misuse the privilege

Considering the period of custody , let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand0 with two sureties of like amount each to the satisfaction of Additional Sessions Judge F.T.C-V, Bhagalpur in S.T. No. 257A/87 arising out of Katoria P.S. Case no. 117/1986.

The trial court is directed to expedite the trial and if the petitioner defaults on two consecutive occasions, his bail bond shall be cancelled by the learned court below.
