Originally, the case was instituted under Section 364/34 of the Indian Penal Code and informant expressed his suspicion against the petitioners and others on the ground that petitioner no. 2 used to give threatening to the victim not to give tuition to the children of petitioner no. 1. In course of investigation, the dead body of victim was recovered and accordingly, the case was converted under Section 302 of the Indian Penal Code.

Learned counsel for the petitioners submits that except suspicion, there is nothing against the petitioners.

It appears that witnesses stated that there was illicit relation between petitioner no. 1 and petitioner no. 2 and in course of giving tuition, the deceased also developed illicit relationship

with petitioner no. 1 which resulted into his murder.

Considering the aforesaid facts and circumstances as well as materials collected by the investigating officer in course of investigation, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No. 31 of 2013.
