ORAL ORDER
5 16-01-2013 Heard learned counsels for the petitioners and the State.
The petitioners are apprehending arrest in a case
registered for the offences punishable under sections 409, 420 and
120B of the Indian Penal Code.
The accusation is of not distributing scholarship money
to the students and with that money solar lights were purchased.
It is submitted that the proposal to purchase the solar
lights was approved by the Aam Sabha and subsequently by the
Patna High Court Cr.Misc. No.17216 of 2012 (5) dt.16-01-2013
concerned BDO. It is further submitted that the amount of scholarship was distributed.
Considering the nature of accusation, in view of this court, this is a case for consideration of regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Chautham P.S. Case no. 88 of 2011 pending in the court of learned C.J.M., Khagaria.
This application is disposed of with the aforesaid observation/direction.
Let this order be transmitted through FAX at the cost of the petitioner.
