Having regard to the nature of three fire arm injuries found on the person of deceased in the post mortem report and their being specific allegation in the FIR of at least two persons causing such fire arm injuries, this Court in view of the inculpatory confessional statement of the petitioner himself for the time being is not inclined to grant bail to him, inasmuch as, he himself has stated that apart from the main accused who had shot two round of fire on the deceased it was he (petitioner) who had caused the third fire arm injury on the person of the deceased.
Considering all these aspects this Court is not inclined
to grant bail to the petitioner at this stage.
The petitioner is in jail custody since 22.09.2012 and
Patna High Court Cr.Misc. No.14324 of 2013 (3) dt.01-10-2013
therefore, his trial may be expedited.
With the aforementioned observation this application
is, accordingly, dismissed.
