Petitioner apprehends his arrest in connection with Khagaria P.S. case no.335/2012 registered under section 409/34 of the IPC.

Admittedly, at the relevant time, petitioner was posted as assistant engineer in Rural Engineering Organization Works division, Khagaria and it is alleged that he did not adjust Rs 2, 70,000/- which was allotted to him for execution of the work.

Learned counsel for the petitioner submits that petitioner handed over the charge in the year 1993 and after such a long gap, present case was lodged and, as a matter of fact, petitioner had already given his charge and moreover, there is no allegation of misappropriation of government money against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let

the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Khagaria P.S. case no.335/2012 subject to condition as laid down under section 438(2) of the Cr.P.C.
