The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 409 and 406/34 of the Indian Penal Code.
The accusation is of misappropriating the construction fund of the school.
It is submitted by learned counsel for the petitioner that the scheme was of the year 1997 when the petitioner was completed the work in 2002 and possession was given to the Headmaster in 2003 when the petitioner received Rs.1,98,000/- when the estimated cost of the construction work was Rs.2,20,400/- and the present case has been lodged in 2010.
Considering the delayed lodging of the case, let the above named petitioner be released on

anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Saharsa in connection with Mahishi P.S. Case No. 150 of 2010, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
