The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 414/34 of the Indian Penal Code. One stolen tractor was recovered when Lal Mohan Rai was apprehended who disclosed the name of his other associates including the petitioner. It is submitted by learned counsel for the petitioner that the recovery was not made from the petitioner and except confession of co-accused, there is nothing against the petitioner. It is further submitted that apprehended accused person has been granted regular bail. This Court sees no reason for the learned court below not to consider to give the same privilege to the petitioner if he surrenders within
