4	13-05-2013 On the basis of report of A.S.I., Barari Police Station,
	District-Bhagalpur, the Senior Superintendent of Police,
	Bhagalpur, reported that the sole appellant, Bhupender Mohan Thakur died. In the report of Sr. Superintendent of Police, Bhagalpur, the date of death of the appellant has been shown as 24-01-2013 but the report of A.S.I. of Barari Police Station; district-Bhagalpur shows that the appellant died on 24-01-2003. Therefore, it appears to me that the date of death, mentioned in the report of Senior Superintendent of Police, Bhagalpur is nothing but only clerical error. Moreover, the death of the appellant is not in dispute. In view of the aforesaid facts, this appeal has abated and accordingly, this appeal stands dismissed as being abated.
