2 07-09-2012 Heard learned counsel for the petitioners and the State. 2. Petitioners in this batch of writ petitions are P.D.S. dealers. They were given foodgrains for distribution under S.G.R.Y., Food for Work Programme. The foodgrains given to them could not be distributed in full. Part of the foodgrain remained with the petitioners as according to the petitioners permit for distribution was not issued by the authorities and as the permit could not be issued, foodgrains were not distributed. In course of time, according to the petitioners, the foodgrain being perishable commodity was also destroyed. Petitioners by filing these writ petitions have challenged the order given to them by the Block Development Officer or other officers asking them to deposit the price of the undistributed foodgrain @ Rs. 13.10 per Kg. which is impugned by the petitioners on the ground that they are not responsible for non-distribution of the foodgrain.

It is submitted that for failure of the authorities

to issue permit, foodgrains could not be distributed to the persons concerned and now for the failure of the petitioners to deposit the amount they are being threatened either with lodging of the First Information Report or initiation of certificate proceeding for recovery of the amount or cancellation of their P.D.S. licence. It is submitted on behalf of the petitioners that similar order has been quashed by the High Court on the ground of being unreasonable and unfair and is reported in 2012 (1) PLJR 168 (Yamuna Nayak @ Jamuna Nayak Vs. The State of Bihar & Ors.). The other order which is being referred to is that of the Division Bench in the case of Yadunandan Upadhyaya (L.P.A. No. 1335/2011) disposed of under orders dated 25.10.2011 in which the Division Bench directed the appellant of the said case to deposit 15% of the value of the undistributed rice at the rate of Rs. 10/- per kg. within six weeks from 25.10.2011.

Petitioners have been served with the notice asking them to deposit the price of the undistributed foodgrain which could not be distributed. In the event petitioners are disputing the direction given to them under the impugned

order/notice, they should have challenged the same before the authority which issued the notice or before the higher authority i.e. D.D.C. or District Magistrate concerned. In case they were not inclined to challenge the direction given in the order/notice, they should have awaited the initiation of the certificate proceeding and should have taken all objections which were open to them before the Certificate Officer who is discharging quasi judicial function under the P.D.R. Act.

directly without approaching the authorities below, I am not inclined to entertain these writ petitions and dispose of the writ

petitions directing the petitioners to either submit their objection before the officer who issued the notice/order or before the S.D.O. or D.D.C. or Collector of the District or Certificate Officer which should be dealt with in accordance with law in the light of the judgments referred to above.
