2 08-11-2012 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is aggrieved by non-payment of arrears of salary as, according to him, there is no justification for withholding the same even then when the departmental proceeding has been dropped and no charges have been proved against the petitioner.

In the facts and circumstances, the writ petition is being disposed of with the observation that if the representation dated 13.8.2012 is pending before the District Programme Officer(Establishment), Banka (respondent No.4), as claimed, then

the said respondent No.4 shall consider and dispose of the same expeditiously and in any event preferably within a period of three months, if possible, in accordance with law.
