2 21-09-2012 Petitioner is an Unemployed Engineers Association represented by its President. The grievance is that though a policy decision of the State Government was taken as far back as in 2008 by Resolution of the Road Construction Department dated 31.01.2008, vide Annexure-1, to earmark 15% of the notified works under plan and non-plan head of all Department for the unemployed engineers, the advertisements inviting tenders for allotment of works which are being issued by different Departments of Muzaffarpur Work Circle, vide Annexures 2 and 3, do not provide for reservation of 15% work for local unemployed engineers although decision of the 2008 has also been

reiterated recently by letter of the Road Construction Department dated 10.07.2012, vide Annexure-5.

Resolution of Road Construction Department dated 31.01.2008 read with letter of the Engineer-in-Chief of the Department dated 10.07.2012, as contained in Annexure-5, itself shows that there is some substance in the claim of the petitioner. Hence, the representative of petitioner-Association shall place this order of the Court before the concerned Engineer-in-Chief with a representation for him to apply his mind to the said claim of the petitioner and to issue necessary directions to all the concerned in accordance with law.

This writ application is disposed of with aforesaid observations and directions.
