3 20-09-2012 Petitioner has filed this writ application for a direction to the respondents to release an amount of Rs.13,89,783/- against supply of steam coal to the Superintendent, Central Jail, Gaya during the years 1996 to 2004.

A counter affidavit has been filed in which supply has been admitted. It is also stated that some amount has been released to the petitioner and orders have already been issued to pay the remaining admitted amount as may be determined by the Collector.

Learned counsels for both the parties are not in a position to inform this Court as to whether rest of the amount of the petitioner has been paid by now or not.

In the circumstances, this writ application is disposed of with a direction to the concerned respondents to get the remaining admitted amount of the petitioner ascertained and pay the same to him positively within two months from the date of receipt/production of a copy of this order, if determination has not yet been made and entire admitted amount has not been paid to him till now. In case, final decision is not taken and remaining admitted amount is not paid to the petitioner within two months, concerned respondent shall be liable to pay interest at the rate of 12% per annum on the admitted due amounts from his own pocket.
