2 22-08-2012 Heard learned counsel for the petitioners, State and for the Staff Selection Commission (hereinafter referred to as the Commission).

The petitioner is acknowledged not to be within the list of 34540 persons approved by the Supreme Court to be considered for appointment as Assistant Teacher. No Court of law can consider any grievance with regard to non inclusion in the same.

But, learned counsel for the petitioner rightly

submits that his grievance with regard to his categorization in the General category as distinct from his reserved status as a

Scheduled Caste candidate is required to be considered by proper disposal of his objections so that he is not prejudiced at the time of consideration with regard to any future vacancy.

Counsel for the Commission submits that any consideration of the objections has to be subject to the petitioner otherwise fulfilling the eligibility criteria that may be prescribed for such future vacancy.
