The petitioner seeks mandamus for arrears of salary from 1.2.1982 to 30.9.1997 after deducting payments made to him from 1.4.1991 to 30.9.1997 on basis of the subsequent order dated 29.7.2006 shifting the date of promotion to the post of Headmaster from 1.4.1991 to 1.5.1982. It is submitted that if there be delay on part of the petitioner, the respondents are equally responsible for having granted promotion to the petitioner from a wrong date subsequently rectified by themselves.
