JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 3 05-12-2012 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This application under Section 482 of the Code of Criminal Procedure is to quash the order dated 02.08.2004 passed in D.B.G. (G.R.P.) 49 of 1988, G.R. No. 340 of 1988 by the Railway Judicial Magistrate, Samastipur, whereby the bailable warrant was issued against the accused-petitioner. A prayer has also been made to quash the entire criminal proceeding arising out of the aforesaid case.
Learned counsel for the petitioner submits that since the petitioner has surrendered before the court below and is on bail, so there is no need of quashing the order dated 02.08.2004. It is further submitted that an application has been filed by the A.P.P. to withdraw the case on the direction of the District Magistrate, Madhubani but the application is still pending for

disposal.
On perusal of the entire record, it appears that the second application has not been annexed in this application. As such, I do not find any justification to quash the entire proceeding. Accordingly, this application is dismissed.
