ORAL ORDER
2 24-07-2012 Heard learned counsel for the petitioner as well as
learned Additional Public Prosecutor for the State assisted
by learned counsel appearing for the informant.
Petitioner is in jail custody since 16-05-2012 in a
case registered under Sections-341, 323, 498A of the
Indian Penal Code.
The contention of learned counsel for the petitioner
is that the informant is not legally wedded wife of the
petitioner and as a matter of fact, she has brought this false
case against the petitioner with intent to pressurize him to
fetch money. It is also pointed out by him that Annexure-3
to the supplementary affidavit reveals that simple injury has
been found on the person of the informant and no injury

was found on her private part.

On the other hand, learned counsel appearing for the informant vehemently opposed the prayer submitting that the petitioner got killed two unborn children of the informant and, furthermore, the petitioner solemnized his marriage with the informant. In support of the aforesaid contention, he showed a photograph.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind the period of detention of the petitioner in jail custody, let the petitioner, namely, Sanjay Lama be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Shastrinagar P. S. Case No. 135 of 2012 to the satisfaction of Chief Judicial Magistrate, Patna.
