The petitioner is in custody in connection with Sessions Trial No.274 of 1993 arising from Yodopur P.S. Case No.52 of 1988 for the offences punishable under sections 147, 148, 149, 302 and 307 of the Indian Penal Code and section 27 of the Arms Act.
The allegation against this petitioner is of catching hold of the legs of the deceased brother of the informant while other accused fired at him causing his death.
Considering the nature of allegation the prayer of the petitioner was refused by order dated 3.2.2012 passed in Cr. Misc. No. 39565 of 2011.
Mr. Umesh Chandra Verma, learned counsel appearing on behalf of the petitioner has submitted that for the allegation aforementioned the petitioner has remained in custody

since 26.9.2011 in the present case. It is submitted that though the charges have been framed but the evidence is yet to start.
Taking into consideration the circumstances and the submission of learned counsel for the petitioner, let the petitioner, namely, Lakhi Chand Bin be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Fast Track Court-V, Gopalganj in connection with Sessions Trial No.274 of 1993 arising from Yodopur P.S. Case No.52 of 1988 subject to the condition that the petitioner shall be personally present on each and every date fixed in the trial and failure on the part of the petitioner on two consecutive dates without reasonable explanation to the satisfaction of the trial court, would entitle the court concerned to cancel his bail bonds and to take him into custody.
