The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

It is alleged that the petitioners’ organization being Kasturba Pratishthan Mahila Silai Centre was sanctioned Rs.3,51000 for five schemes out of which four were completed but fifth scheme worth Rs.1,59000 could not be completed.

It is submitted that the petitioners who are President and Secretary of the aforesaid organization completed major work in the fifth scheme when no audit with regard to the work was done. The petitioners undertake to deposit rupees seventy five thousand within a period of three months from today before the learned court below in connection with the present case which will be

invested in some fixed deposit scheme which will be subject to the result of this case.

Considering the aforesaid submissions, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur in connection with Bihta P.S. Case No. 239 of 2004 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The bail bonds of the petitioners will be accepted provisionally till the deposit of the aforesaid amount.
