Versus
The petitioner as the decree-holder is aggrieved by the order dated 17.10.2008 in Execution Case No. 1 of 1996 passed by the Sub-Judge, Ist, Jehanabad directing the Advocate Commissioner to furnish details of any 3rd persons who may be occupying the suit property as encroachers.
The application is disposed with the observation and direction that if there are any objections to the Execution Case pending, let the same be disposed off forthwith in accordance with law without any unnecessary

delay keeping in mind that the execution case is of 1996.
Subject to the aforesaid, and if there are no orders of a competent Court of law, staying further proceedings in Execution Case No. 1 of 1996, let the execution case itself be taken to its logical conclusion in accordance with law within a maximum period of three months from the date of receipt/production of a copy of this order.
The writ application stands disposed.
