Alongwith show-cause filed on behalf of the Opposite Party No.3, the Superintendent of Police, Bhagalpur several documents have been annexed which include Annexure-D which contains a letter dated

27.11.2003 whereby the petitioner has accepted the receipt

of a letter from the SP’s office dated 06.11.2003 whereby he was directed to submit required informations in support of his claim relating to post retiral or death-cum-retiral benefits of his deceased father, late Rajnath Singh, a Constable who

appears to have been relieved from service on account of his death w.e.f. 16.08.1978 as per Annexure-E to the showcause.

There is no material to hold that the Opposite Parties have deliberately avoided to decide the claim of the petitioner and to take final decision on his representation. In that view of the matter, this contempt application is disposed of. It will be open for the petitioner to submit all the documents and informations available with him to the Superintendent of Police, Bhagalpur within two months from

today. If that is done then a final decision with respect to representation of the petitioner shall be taken by the concerned authorities within two months thereafter. If the details are not furnished within two months, in that event also a final decision in accordance with law deciding the claim one way or the other should be taken within the time indicated above so that there is no necessity of further litigation in the matter.
