The petitioner is the plaintiff in Eviction Suit No. 02 of 2007 in which the respondents are defendants. The respondents are the plaintiff in Eviction Suit No. 06 of 2007 in which the petitioner is the defendant. The suit properties are common in both applications. They seek each others eviction.
The Court finds no reason to interfere with the order dated 3.4.2010 for analogous trial of the two arising out of order in Misc. Transfer Case No. 209 of 2008 passed by the District Judge which has not been challenged at any stage.
The application is dismissed.
