11.02.2009 Heard leaned Counsel for the petitioners and the learned Counsel for the State.

The lands of the petitioners were donated by their respective father for establishment of Tube well. In lieu, the petitioners were provided with appointment in anticipation of government approval. The approval never came. When orders of termination have been passed on 13.4.2002.

This Court is satisfied that the modus operandi adopted by those concerned with whom the petitioners were in hand-inglove cannot be termed ‘legal’ by any sense of term so as to interfere with the impugned order of termination when the appointment itself was illegal.

To that extent the writ application is dismissed.

This shall however not prejudice the petitioners if they

have any claim in law otherwise when it is their own case that the lands were donated by their father.
