2. The petitioner by invoking the writ jurisdiction of this Court has tried to explore the following relief:-

“Under the aforesaid facts and circumstances, more-fully narrated herein above the Petitioner most humbly prays that this Hon'ble Court may graciously be pleased to admit the Writ Petition, issue notice to the Opp. Parties calling upon them to show cause as to why the Selection of O.P. No.6 to the post of Aganwadi Helper of Nankar Anganwadi Centre under O.P.No.2 as per selection dated 28.12.2023 under Annexure held pursuant to Notification dated 28.11.2023 as per Anenxure-1.”

Advocate for the State has referred to the revised guidelines for selection of Anganwadi Workers/Mini Anganwadi Workers/Anganwadi Helpers. By pointing out Clause-10(d) of the said guidelines, he submits that

the grievance of the petitioner could be agitated before the appropriate authority, namely, the District Magistratate/ADM by filing the Appeal. For convenience of ready reference, the provision is reproduced hereunder:-

“10. Disengagement of Anganwadi Workers :- xxx xxx xxx xxx xxx xxx xxx xxx xxx xxx 10(d) The District Magistrate/ADM will be the first appellate authority appellate authority in the hearing of disengagement of Anganwadi Worker. Any person aggrieved by the decision of the District Magistrate/ADM may appeal to the Revenue Divisional Commissioner of the concerned division as the second Appellate Authority. Every appeal should be made within 60 days from the date of issue of order of disengagement, else the disengagement shall be deemed appropriate.”

4. In view of the aforementioned, since alternative remedy is available, the writ petition is disposed of with liberty to the petitioner to resort to the remedy as available to her by filing the Appeal.
