The petitioner is an accused in connection with Kundheigola P.S. Case No. 63 of 2026 registered on the allegation of the alleged commission of offence punishable under Sections 296/351(3)/74 of BNS.

Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R.

The prosecution case is that the complainant gave a written report before the police station alleging therein that when she and her husband were inside their residential house, the accused person came in front of their house and started uttering filthy and

obscene language taking the name of the complainant’s husband. Hearing the same, the complainant came out of the house to protest against such behaviour. At that time, the accused caught hold of her Saree, abused her in filthy language and forcibly tore her Saree. Further, the accused threatened to kill her husband by means of an axe. Being frightened by such conduct, the complainant somehow managed to go inside the house and locked her husband inside for his safety.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedents, therefore the anticipatory bail application of the petitioner may be allowed.

Learned counsel for the State opposed the prayer for anticipatory bail.

Regard being had to the nature of allegation and gravity of offence and the fact that the injuries are simple in nature, I am inclined to grant the petitioner anticipatory bail. Accordingly, it is directed that in the event the Petitioner is arrested, he shall be released on bail by the Arresting Officer, subject to verification of criminal antecedent of similar nature. The release of the Petitioner shall also be subject to the condition that he shall cooperate with the investigation and shall appear before the I.O. as and when his presence is required by the I.O. for the purpose of investigation;
