Blue Lagoon Mandap, Bolangir Vs State of Odisha

Instant writ petition is filed by the petitioner for a direction to the opposite parties and in particular, opposite party No.5 to unseal the Mandap in question at Bolangir with immediate effect with such other relief sought for alleging the impugned action as arbitrary and illegal on the grounds stated.

Referring to a copy of the sale deed at Annexure-1 and the RoR i.e. Annexure-2 and also a receipt issued by the Bolangir Municipality at Annexure-3, it is submitted by Mr. Nanda, learned counsel for the petitioner that the petitioner runs the Mandap, namely, Blue Lagoon Mandap at Bolangir but it has been sealed on 12^th December, 2025 without a formal order. The submission is that the petitioner was indisposed of because of his health condition and was being treated at Visakhapatnam

for ligament surgery, hence, he could not respond to the notices at Annexures-4 and 5, whereafter, without any such order, the Mandap has been sealed by opposite party No.5, which is not legally tenable. In course of hearing, the medical documents as at Annexure-6 series are referred to by Mr. Nanda, learned counsel to satisfy the Court that the petitioner was under treatment at the relevant point of time.

In fact, the Court finds that the notice dated 8^th December, 2025 was issued as a reminder, a copy of which is at Annexure-5 and it was preceded by a notice dated 1^st December, 2025 at Annexure-4. As it appears, since the petitioner did not respond to the above notices, opposite party No.5 has taken the action and sealed the Mandap. In view of the medical condition of the petitioner pleaded with reference to Annexure-6 series, it is submitted by Mr. Nanda, learned counsel that he failed to respond to the last notice i.e. Annexure-5. The submission is that the Mandap should be allowed to be run by the petitioner as many functions and events have already been fixed prior to the action pursuant to Annexure-5, later to which, no formal order has been passed.

Since, the petitioner claims himself to be the owner and in respect of the land over which the Mandap stands and refers to Annexure-2 having purchased the same vide the sale deed i.e. Annexure-1 and deposited the tax to the Bolangir Municipality shown as per Annexure-3, considering the plea of illness and recording the submission of Mr. Swain, learned AGA, the Court is of the view that he should be allowed to submit all the relevant documents as was demanded vide

Annexure-4 for a decision by opposite party No.5. The Court is also of the view that the petitioner, who prima facie appears to be the owner in respect of the plot in question and is running the Mandap, a direction is required to be issued to opposite party No.5 to unseal the same so as to enable it to have the functions and events held already booked prior to 12^th December, 2025, till such time a final decision taken pursuant to Annexure-4.

7. Accordingly, it is ordered.

In the result, the writ petition stands disposed of with the direction as aforesaid. It is further directed that the petitioner shall submit the necessary documents as was instructed vide Annexue-4 and upon receiving the same, opposite party No.5 shall consider and to take a decision as per and in accordance with law. It is further directed that the above decision shall be taken as soon as possible preferably within a period of fifteen days from the date of receipt of a copy of this order, which shall be produced before opposite party No.5 within next three working days positively and till such time, the petitioner shall be allowed to run the Mandap as an interim measure in respect of the events/functions booked prior to 12^th December, 2025.
