1. Heard learned counsel for the Parties.

By means of this application, the Petitioner seeks the following relief:-

“i) Issue a writ of mandamus directing the Opp. Parties particularly the Opp. Party No. 2 and 3 to change the name of the owner (Petitoner) in R.C. Book of the vehicle of the petitioner in accordance with law.;

This Hon'ble Court further be pleased to pass such other appropriate writ/writs, direction/directions, order/orders as would be deem fit and proper in favour of the petitioner.”

The main grievance of the Petitioner is that Opposite Party Nos. 2 and 3 have not acted in accordance with law by making the necessary correction to the ownership details in the R.C. Book of

the vehicle bearing Registration No. OD-19-V-1921 in the manner sought by the Petitioner.

As seen from the averments made in the application and the documents placed on record along with the Writ application, no such material is forthcoming to show that the Petitioner ever moved before the concerned authority for change of ownership in the R.C. Book. In absence of any such application before the authority and order having been passed by that authority, this Court at this position cannot assess the legality/illegality of the authority concerned.

Accordingly, the writ application while being disposed of at the stage of admission, it is directed that the Petitioner may have the liberty to file an application before the authority concerned for the grievance raised herein in accordance with law.

The Writ Petition is accordingly disposed of.
