Heard learned counsel for the parties.

By means of this application, the Petitioner seeks the following relief:

“It is therefore prayed that Your Lordships may graciously be pleased to admit the writ application, to issue notice to the Opp. Parties and after hearing to direct the Opp. Parties for removal of encroachment over the disputed Plot No. 128, Kisam - Road, by disposing of the representation as at Annexure-1 in the interest of justice;

And to pass any other order(s) or direction(s) be deemed fit and proper;”

It is submitted that, in respect of the aforesaid grievance, the Petitioner had earlier approached this Court by filing W.P.(C) No.26941 of 2025, wherein a Coordinate Bench of this Court, vide order dated 13.01.2026, directed the Petitioner to submit a representation before the competent authority, namely, the Commissioner, Puri Municipality, Puri. Pursuant thereto, the Petitioner submitted a representation on 22.01.2026. Learned

counsel for the Petitioner submits that the said representation has not yet been considered and disposed of.

Learned counsel further submits that although the representation was addressed to the Executive Officer, Puri Municipality, the Municipality has since been upgraded to a Municipal Corporation and, therefore, the representation may now be considered by the Commissioner, Puri Municipal Corporation.

In view of the limited grievance of the Petitioner and without expressing any opinion on the merits of the case, the Commissioner, Puri Municipal Corporation (formerly Puri Municipality) is directed to treat the representation dated 22.01.2026 as one addressed to the competent authority and to consider and dispose of the same, in accordance with law, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a certified copy of this order. If considered necessary, an opportunity of hearing shall be afforded to all affected parties before passing an appropriate order.

The Writ Petition is accordingly disposed of.
