State of Odisha & Ors.): The petitioner, an Assistant Teacher, had been issued a show-cause notice by the Block Education Officer, Kuchinda (letter No.965 dtd.20.05.2026, Annexure-3) regarding disengagement/non-renewal of service, and had already submitted his show-cause reply. Apprehending disengagement while the proceeding was pending, he filed the instant writ petition seeking quashing of Annexure-3 and continuation in post; the State contended the writ was not maintainable. Holding that no relief could be granted at that stage as the proceeding was still pending before the B.E.O., Kuchinda, the Court directed the B.E.O. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel appearing for the Petitioner as well as learned Additional Standing Counsel appearing for the StateOpposite Parties. Perused the writ application as well as the documents annexed thereto.

The Petitioner has filed the present writ application with the following prayer:

“Under these circumstances, the petitioner humbly

prays that, this Hon'ble Court may graciously be pleased to admit the Writ Petition, issue Rule NISI, calling upon the Opposite parties more particularly the opposite party No.4 to show cause as to why the letter dtd.20.05.2026 as under Annexure-3 for disengage/non renewal of service of the petitioner shall not be quashed;

If the opposite parties fail to show cause or show insufficient cause, the said Rule may be made absolute in

directing Annexure-3 be quashed;

And further be pleased to direct the opposite parties more particularly the opposite party No.4 to continue the petitioner in his post by considering the show cause reply/representation as under Annexure-4;

And may pass such other order(s)/direction(s) as this Hon'ble Court deems just and proper as circumstances justify in favour of the petitioner.”

Learned counsel for the Petitioner, at the outset, contended that the Petitioner who is working as an Assistant Teacher was issued with a show-cause notice by the Block Education Officer, Kuchinda vide letter No.965 dtd.20.05.2026 regarding disengagement from service of the Petitioner. Learned counsel for the Petitioner, at this juncture, contended that the Petitioner has already submitted his show-cause reply. He further contended that since the Petitioner apprehends that the B.E.O., Kuchinda might disengage the Petitioner, therefore, he has approached this Court by filing the present writ application.

Learned counsel for the State, on the other hand, contended that the present writ application is not maintainable as the Petitioner has already submitted his show-cause reply to the show-cause notice issued by the B.E.O., Kuchinda. In such view of the matter, learned counsel for the State contended that the writ application is not maintainable and, hence, the same be dismissed.

Having regard to the submissions made by learned counsels for the parties, on a careful examination of the background facts as well as the documents annexed to the writ application, further

taking note of the nature of the relief prayed for in the present writ application, this Court is of the view that no such relief can be granted by this Court at this stage as the proceeding is still pending before the B.E.O., Kuchinda. In view of the aforesaid position, this Court deems it proper to dispose of the writ application by directing the B.E.O., Kuchinda, Opposite Party No.4 to make every endeavour to conclude the proceeding as expeditiously as possible, preferably within a period of eight weeks.

With the aforesaid observations/ directions, the writ application stands disposed of.

Issue urgent certified copy of this order as per Rules.
