1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.

Learned counsel for the Petitioner-Defendant No.2 at the outset contended that the Defendant No.2 has approached this Court by filing the present application under Article 227 of the Constitution of India for a direction to the learned trial Court to expedite the trial in Civil Suit No.12 of 2022 pending in the Court of learned Senior Civil Judge, Baripada in the district of Mayurbhanj.

Learned counsel for the Petitioner further submitted that the Opposite Party-Plaintiff filed a suit for declaratory reliefs. He further contended that although the trial of the suit has commenced however the evidence on the Plaintiff site has been concluded, the dispute

involved in the suit relates to the election of the Mayurbhanj Athletic Association, Baripada. It was also contended that in the meantime the tenure of the Committee has already been expired.

Taking into consideration the urgency involved in the matter and further keeping in view the nature of dispute, this Court deems it proper to dispose of the CMP application by granting liberty to the Petitioner to move the learned trial Court by filing the application and submit a copy of today’s order. In the event, the learned trial Court shall make every endevour to expedite the trial and to conclude the same if possible preferably by end of December, 2026 for consideration.

With the aforesaid observation and direction, the CMP application stands disposed of.
