Heard learned counsel for the Petitioners and learned Standing Counsel for the State.

The petitioners have approached this Court with the following

prayer:-

“In the aforesaid facts and circumstances, it is therefore most humbly prayed that this Hon'ble Court may graciously be pleased to: (i) Issue Rule NISI calling upon the Opposite Parties to show cause as to why the impugned enhancement/revision of Benchmark Valuation in Jharsuguda District shall not be quashed; (ii) Issue an appropriate writ/writs, order/orders or direction/directions quashing the impugned revision/enhancement of Benchmark Valuation

made by the District Level Valuation Committee, Jharsuguda as under Annexure-7;

(ill) Direct the Opposite Parties to undertake fresh determination/revision of Benchmark Valuation strictly in accordance with law after ensuring transparency, proper publication and wide circulation of public notice inviting objections and suggestions from the public; (iv) Direct the Opposite Parties to consider granting appropriate relaxation regarding registration of part plots beyond 500 Sq. Mtrs. to enable poor and middle-class people to purchase small portions of land for residential purposes; (v) Pass an interim order staying operation and implementation of the revised Benchmark Valuation during pendency of the writ 'petition; (vi) Pass such other order/orders as this Hon'ble Court may deem fit and proper in the interest of justice.

And for this act of kindness, the Petitioner as in duty bound shall ever pray.”

Since the order impugned can be challenged in appeal before the State Government, the Writ Petition is disposed of granting liberty to the petitioners to prefer appeal within ten days from today. If such appeal is preferred, the appellate authority shall do well to hear and dispose of the appeal by passing a reasoned order as early as possible, preferably within a period of eight weeks from the date of filing of the appeal after hearing all concerned.
