Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners have approached this Court with the following

prayer:-

“ It is, therefore, prayed that this Hon'ble Court be pleased to;

i) Hold that impugned Govt. RDM Dept. letter dt.02.07.2025 in Annexure-3 is not applicable to the Plot of the petitioners thereby further hold and declare that the impugned unilateral Change of Status of petitioners Plot No.1731, Kisam-Bagayat-1 in Khata No.725/80 of Mouza-Kalarahanga, TahasilBhubaneswar from "Stitiban" to "Pattadar" through Sou-Moto Mutation Misc. Case 6254/2025 based on Revenue & DM Dept. Letter No.23868 dt.02.07.2025 as

bad and illegal and the law laid down in Judgment dt.23.12.2025 passed in WP(C) No. .33794/2025 ( Kunjalata Rout and Others -V- State of Odisha and Others ) as well as violative of the mandatory principles of natural justice and a nullity in the eye of law; and thereby further;

ii) Direct the OP.No.2 to restore the Status of the plot in question of the petitioners from "Pattadar" to "Stitiban" and record the same in the names of petitioners in RoR in respect of aforesaid Plot No.l731, in same manner as made in case of Kunjalata Rout inAnnexure-5 and 6;

iii) Pass such other order(s) as deemed fit and proper in the bonafide interest of justice;

And for which act of your kindness, petitioner shall as in duty bound, ever pray.”

It is stated at the bar that the case of the petitioners is covered by the judgment rendered by this Court recently in the case of Gargi Dash v. State of Odisha & Others [W.P.(C) No.2870 of 2026] & Batch.

Considering the submissions as above, the Writ Petition is disposed of directing the Tahasildar, Bhubaneswar to consider the prayer of the petitioners in light of the aforementioned judgment of this Court. A decision in this regard shall be taken within six weeks from the date of production of certified copy of this order by the petitioners.
