At the outset, learned counsel for the Petitioner submits that inadvertently the Sub-Collector, Redhakhol has not been arrayed as a party. He seeks leave to file corrected cause title impleading the said Sub-Collector, Redhakhol as Opposite Party No.5.

The Prayer is allowed.

Heard learned counsel for the Petitioner, learned counsel for the State and learned counsel for the Opposite Party No.4.

Assailing the alleged illegal and arbitrary action more particularly of Sarpanch of Luhapanka Grama Panchayat-Opposite Party No.4 cancelling the lease of fruit garden of Luhapanka Gram Panchayat, the present writ petition has been filed by the Lesee-Petitioner.

During the course of hearing, it came to the light that in terms of Rule 48(17) of the Odisha Grama Panchayat Rules, 2014, which has been framed under Section 150 of the Orissa Grama Panchayats Act, 1964, the Petitioner has effective alternative remedy. The said Rule 48 (17) of the Odisha Grama Panchayat Rules, 2014 reads as under:-

“17. Any bidder aggrieved by the action of the officer, conducting auction under these rules may within fifteen days of the order appeal to the SubCollector who may stay, set aside or confirm the said order.”

In view of the same, the Petitioner is at liberty to take recourse to the statutory remedy and taking into account the submission of the learned counsel for the Petitioner that he has approached this Court bonafide and since the Opposite Party No.4 has already entered appearance, the Sub-Collector, Redhakhol who has been impleaded on the prayer of the Petitioner as Opposite Party No.5, shall do well to hear the matter on merits in the event Petitioner prefers appeal within 10 days hence.

Accordingly, the W.P.(C) stands disposed of.
