The Writ Petition was filed by the present Petitioner who is stated to be a social worker and inhabitant of village Baipur seeking the following relief:-

“It Is therefore humbly prayed that this Hon'ble court may be graciously be pleased to admit the PIL, writ petition issue RULE NISI calling upon the Opp-parties to show cause as to why the construction of Baipur Jena Sahi community- cum- Cultural centre is illegal as the said plot is generally used by the villagers of Baipur as village Road, Plot No.84, Hal Khata No.111. If the Opp-parties fail to show cause so in sufficient cause, the said rule be made absolute in granting reliefs prayed for.”

The essence of the dispute is that notwithstanding the feasibility report of Jena Sahi Community-Cum-Cultural Centre of Mouza- Baipur under BBGBO Scheme having Hal Plot No-85 appertaining to Khata no-112 on extraneous consideration the construction work is being undertaken on Plot No.84 appertaining to Khata no111 of the said Mouza which is a communal land.

The matter was taken up on 03.07.2026 considering that the matter falls within a narrow compass, the learned counsel for the State was requested to obtain instructions.

The copy of such instruction which is taken on record is also served on the learned counsel for the Petitioner in Court.

On going through the said instruction as well as the report submitted to the Tahasildar by the R.I. and the enclosed map, this Court does not find any substance in the submission of learned counsel for the Petitioner that there is any substantial change of the place of construction of Jena Sahi CommunityCum-Cultural Centre of Mouza-Baipur under the BGBO Scheme (Bikasita Gaa Bikasita Odisha). Inasmuch, as borne out from the instruction, the majority part of the said Community-Cum-Cultural Centre is being constructed under the Plot No.85 and “some area measuring approximately 100 Barga Kadi of Plot No.84 under Khata No.111 (Sarbasadharana), classified as Kisam Rasta” is being utilized.

It is further stated that the construction has not caused any obstruction to the existing road. 7. Considering the same, this Court is of the considered view that no further order need be passed in the case at hand.
