01. 1. This matter is taken up through Hybrid Mode.

2. Heard learned counsel appearing for the parties.

3. The present Writ Petition has been filed inter alia with the following prayer:

It is therefore prayed that let this Hon’ble Court may graciously be pleased to issue notice in Rule Nisi calling upon the Opp party No.2 shall not connect the electricity of Petitioner shop room with a stipulated period;

And may pass any such other order/orders or direction/directions issued so as for give complete relief to the Petitioner.

And for this act of kindness, the Petitioner as in duty bound shall ever pray.

4. It is contended that on the face of the representation made by the Petitioner to provide electricity connection, the authorities are not providing the same.

5. On instruction, learned counsel appearing for the TPCODL contended that power supply provided to the Petitioner was disconnected basing on the letter issued by the landlord-Opp. party No.3. It is also contended that Petitioner is a tenant in the shop-room in question so owned by Opp. Party No.3. It is also contended that there is a civil suit pending in between the Petitioner and Opp. Party No.3 before the Civil Judge (Jr. Divn), Cuttack in C.S. No.1181 of 2024. It is accordingly contended that since the power supply was disconnected, on instruction made by the consumer, who happens to be Opp. Party No.3, no separate power supply can be provided to the Petitioner . It is further contended that if Petitioner is eligible and entitled to get any power connection, she can made such a prayer in the suit which is pending at her instance.

6. At this point of time, learned counsel appearing for the Petitioner prays for withdrawal of the Writ Petition with liberty to move the Civil Court to get the relief.

7. With the aforesaid liberty, the Writ Petition stands disposed of.
