1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as the learned counsel for the State-Opposite Parties. Perused the writ petition as well as the documents annexed thereto.

The present writ petition has been filed by the Petitioner with the following prayers:-

“ In the facts and under the circumstances mentioned above, it is humbly prayed that this Hon'ble Court may graciously be pleased to admit the writ application, issue appropriate writ/writs, order/orders, direction/directions by directing the Opp. Party Nos.1 & 3 to re-fix the Grade Pay of the husband of the Petitioner at Rs.4,200/- in accordance with the said Notification dated 21/08/2024 and further be pleased to direct to release the arrears within a stipulated period.

And/or pass any other order(s)/direction(s) as this Hon'ble Court thinks fit and proper. ”

Learned counsel for the Petitioner submits that the claim of the Petitioner is supported by the Odisha Administrative Tribunal (OAT) decision in O.A. No.2576 of 2016, which has been affirmed by Division Bench of this Court in W.P.(C) No.7281 of 2018 between State of Odisha & Ors. v. Saraswati Bhoi & Ors., 2022 (II) ILRCUT-629. He also notifies to the Court that the said decision has been affirmed by the Apex Court. He also submits that if liberty is reserved, his clients would make a representation and accordingly a direction be issued for consideration of the subject representation in the light of Division Bench decision. This is fair enough.

In the above circumstances, the writ petition is disposed of. Petitioner to make representation within a period of three weeks and if one is made, jurisdictional Opposite Parties shall take a decision thereon within a period of eight weeks next following. All contentions are kept open.
