Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

By filing the present writ petition, the Petitioner has prayed for the following relief:-

“It is therefore prayed that this Hon'ble Court may graciously be pleased to admit this writ petition and issue writ of mandamus directing the Opp. parties, more particularly to the Opp. party No.4 i.e. the District Education Officer (D.E.O), Mayurbhanj to give compassionate appointment to the petitioner under Rehabilitation Assistance Scheme as per the pending proper R.A. Application made on dated 14.09.2021 (under Annexure-5 series) and considering the petitioner's representation dated 12.12.2024 (under

Annexure-6) within a stipulated period for the interest of justice;

And/or pass any other appropriate writ/writs, order/orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.”

Learned counsel for the Petitioner, at the outset, contended that the father of the present Petitioner, namely, Late Debjyoti Das, who was working as a Hindi Teacher in Simanta High School at Bhaduasole under Rasagobindapur Block in the District of Mayurbhanj, died in harness on 24.12.2020. After the death of the deceased Government employee, the Petitioner being one of the legal heirs submitted an application for appointment on compassionate ground under the R.A. Scheme on 14.09.2021. The sole grievance of the Petitioner in the present writ petition is that although he has submitted his application on 14.09.2021, however, no final decision has been taken on such application. As a result of which, the entire family of the deceased Government employee including the Petitioner are suffering.

Learned Additional Standing Counsel appearing for the StateOpposite Parties, on the other hand, contended that although the Petitioner has no specific instruction in the matter, however, looking at the grievance as narrated in the writ petition, he will have no objection in the event this Court directs the Opposite Party No.4-The District Education Officer, Mayurbhanj, Baripada to consider the application of the Petitioner for appointment on compassionate ground dated 14.09.2021 strictly in accordance with law and within a stipulated period of time.

Considering the submissions made by the learned counsels appearing for the respective parties and without expressing any

opinion on the merits of the case, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.4-The District Education Officer, Mayurbhanj, Baripada to consider the grievance of the Petitioner strictly in accordance with law and dispose of the application of the Petitioner for appointment on compassionate ground dated 14.09.2021 within a period of two months from the date of communication of this order. The grievance of the Petitioner shall be addressed by passing a speaking and reasoned order and such final order shall be communicated to the Petitioner within ten days from the date of passing such order.
