Upon hearing both parties and considering the grounds mentioned in the petition, delay in filing the appeal is condoned. 3. The I.A. is disposed of.

Though the matter is listed under heading ‘For Orders’, but on the request of learned counsels for the parties, the matter is taken up for final disposal.

Present appeal by the Insurer is directed against the impugned judgment/award dated 19^th December 2025 passed by the Commissioner for Employee’s Compensation-Cum-Joint Labour Commissioner, Jajpur, in E.C. Case No.08/2021, wherein

compensation to the tune of Rs.16,37,502/- on account of death of the deceased in course of his employment as helper in a Truck bearing Registration No.OR-04-6172.

In course of hearing, it is submitted by Mr. Patnaik, learned counsel for claimants-Respondents No.1 to 5 that a consolidated amount of Rs.13,25,000/- as compensation would satisfy his purpose. Accordingly, when Appellant-Insurer is suggested with aforesaid amount, Mr.Satpathy, learned counsel for the Appellant leaves it to the discretion of the Court. As such, the reduced compensation of Rs.13,25,000/- as suggested on behalf of claimants-Respondents No.1 to 5 and not objected by Appellant-Insurer, is determined.

Since the entire compensation amount has already been deposited before learned Commissioner, out of the same a consolidated sum of Rs.13,25,000/- (Thirteen lakhs twenty five thousand only) along with accrued interest thereof be disbursed in favour of the claimants-Respondents No.1 to 5 within a period of two months from today. The rest amount along with proportionate accrued interest shall be refunded to the Insurer-Appellant.

The appeal is disposed of accordingly.
