Present appeal by the insurer is directed against the judgment and award dated 21.05.2025 passed in E.C. Case No.247/2020/CUTT by the Commissioner for Employee’s Compensation-cum-Joint Labour Commissioner, Cuttack, wherein compensation to the tune of Rs.24,93,521/- along with interest @12% per annum from the date of accident has been granted to the claimant-Respondent No.1 on account of injury sustained by him in course of and arising out of the employment as a helper in Hywa Truck bearing Registration No.OD-05-AV2820 belonging to Respondent No.2.

In course of hearing, it is submitted by Mr. Patnaik, learned counsel for claimant-Respondent No.1, that a consolidated amount of Rs.12,00,000/- as compensation would satisfy his purpose. Accordingly, when Appellant-Insurer is suggested with aforesaid amount, Mr. Khan, learned counsel for the Appellant leaves it to the discretion of the court. As such, the reduced compensation of Rs.12,00,000/- as suggested on behalf of claimant-Respondent No.1 and not objected by the AppellantInsurer, is determined.

Since the entire award amount has been deposited before the learned Commissioner, out of the same, a consolidated sum of Rs.12,00,000/- (Rupees Twelve Lakhs only) along with accrued interest thereof be disbursed in favour of the claimant-Respondent No.1 within a period of two months from today. The rest amount along with proportionate accrued interest shall be refunded to the insurer – Appellant.
