2. Mr. P.K. Behera, learned counsel submits that the matter no more survives for adjudication before this Court as the dispute between the petitioner-husband and the opposite party-wife in the marriage in the present application has been resolved. All the pending cases between the parties have ended up in amicable settlement/closure/disposal.

3. He files memo of date enclosing attested photocopy of the judgment dated 07.07.2025 passed by the learned Judge, Family Court, Cuttack in C. P. No.67 of 2023 under Section 13(B) of Hindu Marriage Act, 1955. The said petition under Section 13(B) of the Hindu Marriage Act was filed by the husband-Arakshita Sethi as well as wifeSasmita Behera. The operative portion of the judgment is reproduced herein:

“ The petition Under Section 13(B) of the Hindu Marriage Act, 1955 filed by the petitioners is allowed. The marriage solemnized between the petitioners on 22.02.2015 stands dissolved, by a decree of divorce on mutual consent Under Section 13(B) of the Hindu Marriage Act, 1955. The joint petition dated 19.06.2025 filed to that effect does form part of the decree.”

4. Memo filed by the learned counsel for the petitioner encloses attested photocopy of the order dated 11.07.2025 passed by the learned Judicial Magistrate First Class-IV, Cuttack in Ex. DVMC-01/2021 (Sasmita Behera v. Arakhita Sethi), the said order is reproduced herein:

“The case record is put up today on the strength of an advance petition filed by the Ld. Advocate for the petitioner. The petitioner files a petition through her advocate to withdraw the case against the OP. Ld. Counsel for the petitioner submitted that the marriage has already been dissolved on mutual consent between the petitioner and the OP and the petitioner does not want to proceed further in this case. Perused the case record. On perusal of the case record it is found the case is pending at the stage of hearing. In view of the above circumstances and considering the nature of dispute this court is of view that no fruitful result will be served in proceeding with the case. Hence, the petition to withdraw the case is allowed for the ends of justice. The case is disposed of as withdrawn.”

5. Also enclosed to the memo attested photocopy of the order dated 13.09.2025 passed in CMC No.287/2018 by the learned Civil Judge (Junior Division), 2^nd Courtcum-JMFC, Cuttack, the said order is reproduced herein:

“The case record is posted today in the National Lok Adalat for consideration of withdraw petition dtd.18.07.2025 filed by the petitioner. She submitted that she does not want to further proceed in this DV case as the matter has already been settled between both the parties. Hence, the

petitioner wants to withdraw her case. Heard, the petition and perused the case record. On perusal of withdrawn memo as well as case record the court found that the memo filed by the petitioner is lawful. So, considering the facts and circumstances of this case, the withdrawal petition of petitioner is allowed to upheld the interest of justice.”

6. Petitioner in the application Shri Arakshita Sethi is present in Court, who is also identified by the learned counsel. Photocopy of Aadhar Card is also produced by the petitioner. The same shall be taken on record.

7. The petition is disposed of.

While parting with the case, this Court puts on record appreciation of efforts of the learned counsel for the petitioner as well as efforts of the petitioner to arrive at a amicable settlement between the parties which is in the best interest of both the parties.
