Opposite Parties to conduct fair, proper and expeditious investigation in Talabania PS Case No. 233 of 2025 and direct inclusion of the relevant provisions of the POCSO Act.

Perusal of the CRLMP reveals that on the complaint of

the petitioner, who is the mother of the minor victim, Talabania PS Case No. 233 of 2025 was registered on 31.10.2025 under

Section 140(2)/137(2)/296/351(2)/3(5) of the BNS read with Section 3(1)(i)/3(1)(r)/3(1)(s)/2(va) of the SC and ST (POA) Act, 1989.

Mr. Pradhan, leanred Additional Standing Counsel produces the instruction dated 15.05.2026 of the IIC, Talabania Police Station which contains the steps taken for investigation. It has been stated that the accused CCL has been apprehended and produced before the PM, JJB, Puri and prayer for issuing NBW against accused Bibhu Prasad Mahapatra has been made before the Court.

Since the victim is a minor, if during the course of investigation, materials disclose commission of offences under the POCSO Act, it is the duty of the IO to add the said offences and take steps in accordance with law for investigation and apprehension of the accused Bibhu Prasad Mahapatra, who is stated to be intentionally absconding to avoid police arrest.

With the above observations and directions, the CRLMP is disposed of.
