This CRLMP has been filed for a direction to the Opposite Party No.3 to register the FIR as per petitioner’s complaint dated 03.02.2026 and for further direction to the Opposite Party No.3 to take necessary action in accordance with law.

Apat, learned Additional Government Advocate produces the instructions dated 02.05.2026 of the IIC, Baliapanda Police Station, Puri, where it is stated that on the written report of the petitioner Baliapanda PS Case No. 107 of 2026 under Section 316(2)/351(2) of the BNS has been registered. It appears that as the date of registration of the FIR has not been deliberately indicated. Hence, Mr. A. K. Apat, learned Additional Government Advocate is directed to obtain instructions over telephone regarding the date when the FIR has been registered. It has also been stated that Baliapanda PS Case No. 72 dated 22.03.2026 has been registered against the petitioner and his associates on the complaint of

Ghunguru Mishra under Section 329(2)/115(2)/296/126(2)/305(a) of the BNS and that the flat has been purchased on 12.10.2023 in partnership but on account of dispute between the parties, both of them tried to possess the flat irrespective of the agreement and presently, Ghoonguru Mishra is in possession of the flat. Both the parties have been asked to produce related documents in connection with the flat for further investigation and follow up action. The same is taken on record.

Mr. A. K. Apat, learned Additional Government Advocate submits that the IIC has informed over telephone that the case has been registered on 02.05.2026.

It is apparent that on account of delay in registration of the case, the IIC has deliberately not mentioned the date of registration of the case in his instruction.
