1. This CRLMP has been filed with the following prayer;

“It is, therefore, humbly prayed that this Hon'ble may graciously be pleased to issue Rule NISI, calling upon the Opp. Parties to show cause as to why a writ of mandamus should not be issued directing the Opp. Party no.2 and 3 to take appropriate action against the culprit and maintain breach of peace over the suit land i.e Plot no. 770 under Khata No.317, Mauza Immam Nagar, Tahasil Salipur, P.S. Jagatpur, Area Ao.62 decimals and restrain the property from new construction.

And in the event the Opp. Parties fail to show cause and show insufficient cause make the said Rule absolute directing the Opp. Party no.2 & 3 to take action against the culprit and maintain breach of peace over the suit land and

restrain the suit land from new construction.

And pass such other order/orders, direction/directions as this Hon'ble Court may deem fit and proper in the circumstances of the case,

And for this act of kindness the petitioner shall as in duty bound ever pray.”

After hearing learned counsel for the petitioner and perusing the CRLMP, I am not satisfied that any writ of mandamus should be issued to the Opposite Party No.3.

The CRLMP is disposed of granting liberty to the petitioner to approach the appropriate authority/forum for redressal of his grievances.
