This CRLMP has been filed for a direction to the Opposite Party No.3 to execute warrant issued by the Court of learned JMFC, Nimapara in Execution Case No.137 of 2022.

Pursuant to the order dated 04.11.2022 passed in Criminal Misc. Case No.87 of 2020 filed under Section 12 of the Protection of Women from Domestic Violence Act, the Petitioner had initiated Execution Case No.137 of 2022 before the learned JMFC, Nimapara. As no steps had been taken on behalf of the Respondent therein, by order dated 24.02.2023, Distress Warrant had been issued against him. In spite of several adjournments including order dated

28.06.2024, Distress Warrant had not been executed, for which the Petitioner had approached this Court.

Pursuant to Orders dated 02.01.2025, 20.01.2026, 29.01.2026 and 05.02.2026, the IIC, Niali Police Station has sworn an affidavit dated 13.02.2026 wherein he has stated that he joined in his post on 25.01.2026 and as per direction, raid was conducted by the ASI of the Police Station on 12.02.2026 in the rented house of the warrantee-Kashinath Das and he was apprehended on 13.02.2026 and forwarded to the Court of learned JMFC, Nimapara.

Mr. S.J. Mohanty, learned Additional Standing Counsel submits that the said affidavit shall be e-filed in course of the day. It shall be scanned and incorporated in the digital record. The copy of the said affidavit filed by him is taken on record.
