1. Heard learned counsel for the Parties

By means of this application, the Petitioner seeks the intervention of this Court for a direction to the IIC, Binjharpur P.S. to register the FIR and to take action on the basis of the Petitioner’s complaint dated 22.01.2026 and also to protect the interest of the Petitioner in the AWC, Bodua-2.

Mr. Panda, the learned Addl. Govt. Advocate placed the written instructions of the Superintendent of Police, Jajpur in the shape of an affidavit, the same is taken on record.

Perusal of the recitals in the affidavit reveals that the matter having been considered, the Binjharpur P.S. Case No.91 of 2026 has been registered against the accused persons and the Collector, Jajpur has also issued direction to the Superintendent of Police, Jajpur to ensure Law and Order situation at Bodua-2, AWC for its smooth functioning. The instruction further reveals that subsequent to the passing of the order by the Collector, Jajpur, the Petitioner has not turned up to the Police Station for any other disturbances from the side of her brothers. It is also made clear in the affidavit itself that upon passing of the order by the Collector, Jajpur dated 10.01.2025, police is under obligation to provide necessary legal protection for smooth functioning of the AWC and if any, specific allegation will be reported, action as deemed proper will be taken as per law on the basis of prima facie material.

Having regard to the aforesaid instructions and the order of the Collector, Jajpur, it appears that there is a constant faulting of the effort of the Petitioner in functioning of the Bodua-2 AWC by the accused persons. Accordingly, deployment, if necessary be made of the police personnel to ensure the Law and Order situation as

and when so necessary in the opinion of the Superintendent of Police, Jajpur.
