This CRLMP has been filed with a prayer for direction to

the Opposite Party-Police Officers not to harass the Petitioners, who

are the family members of one Sekh Mohammad Wajid @ Chhotka

in connection with Jagdalpur P.S. Case No.03 of 2026, arising out of

G.R. Case No.31 of 2026 pending in the Court of learned SDJM, Padampur. There is also a prayer for a direction to Opposite Party No.3, Superintendent of Police, Bargarh to take up investigation in relation to the above mentioned matter and take action against the erring officials.

It appears that Jagdalpur P.S. Case No.03 of 2026 has been registered against one Pyarelal Sahu as it was found that he was driving the Hywa without a number plate and transporting sand without any valid documents, such as, e-transit pass. During enquiry it was found that one Chhotka was the owner of the vehicle.

Ms. S.S. Ojha, learned counsel for the Petitioners submits that the Police Officers had come to the house of the Petitioners enquiring about the whereabouts of Sekh Mohammad Wajid @ Chhotka in the process harassing the Petitioners though they are not the accused persons in the case. She submits that during pendency of this CRLMP, Sekh Mohammad Wajid @ Chhotka has been granted anticipatory bail by this Court vide order dated 06.02.2026 passed in ABLAPL No.806 of 2026. She also fairly submits that after the anticipatory bail was allowed, the Police Officers have not come to the house of the Petitioners.

Perusal of the order passed in ABLAPL No.806 of 2026 reveals that the prayer for anticipatory bail of Sekh Mohammad Wajid @ Chhotka has been allowed with the condition that he shall cooperate the I.O. in the investigation as and when necessary and summoned.

Considering the above submissions, this Court is of the view that the Police Officers must have gone to the house of the Petitioners inquiring about the whereabouts of Sekh Mohammad Wajid @ Chhotka, whose prayer for anticipatory bail has subsequently been allowed.

There will therefore not be any necessity for the Police Officers to go to the Petitioners’ house, unless Sekh Mohammad Wajid @ Chhotka does not cooperate with the investigation or does not respond to summons.
